The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

The proposed SOP should adopt a child-centred, rights-based and coordinated approach for children affected by parental or guardian incarceration. Every child should be promptly identified through coordination among prisons, Child Welfare Committees, District Child Protection Units, schools and local authorities. An individual care plan should address education, healthcare, nutrition, emotional well-being, safety and family relationships. Children living with an incarcerated parent should receive safe, hygienic and child-friendly facilities, while children outside prison should receive suitable family-based care or other appropriate support based on their best interests. The SOP should ensure regular welfare assessments, case documentation, periodic reviews, grievance redressal, confidentiality, trained personnel and clear inter-departmental responsibilities. The child’s dignity, privacy, safety, development and best interests must remain the guiding principles.

Zero Stigma & Automatic Safety Net SOP 1. Invisible Children Register: Police at FIR stage must ask "Do you have children below 18?" and within 24 hrs inform CWC. Many children become invisible and face abuse, this will stop it. 2. No Institutional Dress/Label: Such children in CCI must never be labelled as "prisoner's child". Same uniform, same treatment. 3. Mother-Child Separation Audit: No child above 6 years should stay inside jail. Before separation, child's health, vaccination, Aadhaar, Anganwadi linkage must be completed by Jail Welfare Officer. 4. Monthly Trauma Counseling:* Mandatory play therapy and one female counselor visit for children affected, not only those living in jail. Focus on no domestic violence after parental arrest.

In India, the social stigma of a parent’s crime heavily impacts the child. When children are sent to live with extended families, they are frequently subjected to domestic mistreatment, isolation, or are treated as an economic burden recommendation: The Child Welfare Committee (CWC) should never automatically assume kinship care is the safest option. A mandatory "Stigma and Safety Audit" must be conducted by the District Child Protection Unit (DCPU) before placing a child with relatives. If the extended family shows judgmental or abusive tendencies, state-funded secular group hostels or independent foster care must be prioritized. As a citizen of India, introduce a legal requirement for courts to consider a Child impact report prepared by probation officers before sentencing primary caregivers to long prison terms, prioritizing non-custodial sentences where prohibited. Make fund and facilitate peer support networks through local community centers so these children share experiences.

Children should never suffer because their parents are incarcerated. They may face emotional stress, financial difficulties, disruption of education and social stigma. The proposed SOP should ensure early identification of every affected child and confidential assessment of their safety, health, education and care needs. Wherever safe and appropriate, children should remain with the other parent or trusted relatives rather than being separated from their family. They should receive uninterrupted education, healthcare, nutrition, counselling and access to eligible welfare schemes. Child-friendly prison visits, phone calls and video communication should help maintain family bonds. Schools and authorities should protect children from discrimination, abuse, child labour, trafficking and exploitation. Effective coordination among police, prison authorities, Child Welfare Committees, DCPUs, schools, health services and NGOs can ensure timely support. The best interests, safety, dignity and d

Children of incarcerated parents face severe psychological, social, and economic trauma without having committed any crime. To ensure their rights and dignity, the proposed SOP should focus on: Immediate Identification & Tracking: When a parent is arrested, police must record details of dependent children immediately and alert the local Child Welfare Committee (CWC) / District Child Protection Unit (DCPU) to prevent abandonment or discontinuation of schooling. Education & Financial Support: Ensure continuity in local government/aided schools without requiring documents linked to the detained parent. Provide conditional social security stipends to kinship caregivers (e.g., grandparents). Child-Friendly Visitation: Replace physical bars/screens with dedicated, welcoming interaction spaces inside or near prison facilities. Integrate subsidized video calling to maintain parental bonds safely.

Children of incarcerated parents should be identified early and given counselling and education support. They should also get periodic supervised visits with their parent. A district-level system should track their welfare, and their identity should stay confidential to avoid stigma in school and public life.

Key suggestions for the proposed SOP on the Care and Protection of Children of Incarcerated Prisoners:Confidential Database: Establish a district-level registry to track these children and ensure they seamlessly receive existing welfare benefits and healthcare.Child-Friendly Visits: Redesign prison meeting rooms to be open and barrier-free (removing glass/mesh partitions) to minimize trauma and support family bonding.Mental Health & Support: Mandate regular psychological counseling via schools or local Child Welfare Committees (CWCs) to tackle social stigma and isolation.Educational Continuity: Provide direct financial aid, free learning materials, and residential school options to prevent dropouts, child labor, or early marriage.Support Kinship Care: Prioritize financial and legal assistance to extended families or relative guardians so children can stay in a family environment rather than childcare institutions.

Key Suggestions for the SOP on Care and Protection of Children of Incarcerated Prisoners** 1. **Age-Appropriate Categorization in Children's Homes:** Children staying in Child Care Institutions (CCIs) or Homes should be categorized and grouped according to their age bracket to ensure proper care, safety, and targeted development: * **Group 1:** Up to 8 years old * **Group 2:** 9 to 14 years old * **Group 3:** 15 to 18 years old 2. Vocational and Skill Development Training:** Arrangements for age-appropriate Skill Development and Vocational Training programs should be made within the Homes to empower these children and prepare them for self-reliance and smooth social reintegration. 3. **Full-Time Psychiatrist/Counselor Support:** A full-time Psychiatrist or Mental Health Professional should be appointed in every Home to address psychological trauma, provide r
