The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

Every child affected by parental incarceration deserves safety, dignity, education, healthcare, and emotional support. The SOP should ensure early identification of such children, regular monitoring, access to counselling and education, and protection from neglect, stigma, and exploitation. Coordination among prisons, Child Welfare Committees, police, schools, healthcare providers, and NGOs should be strengthened. Decisions should always prioritize the child’s best interests, privacy, family relationships, and rehabilitation. A clear grievance-redressal mechanism and periodic review should also be included to ensure effective implementation.

Respected Sir/Madam, I am Prashant Kumar, a student and citizen, and I am submitting the attached policy proposal for consideration under the ongoing consultation on the care and support of children affected by parental incarceration. Through this submission, I have tried to present a child-centred, practical and implementable framework focusing on early identification, continuity of education, healthcare, safe caregiving, family contact, privacy, protection from exploitation, inter-departmental coordination and proper follow-up. My intention is to contribute a citizen’s perspective towards ensuring that a child does not face loss of education, dignity, identity, safety or opportunities because of circumstances arising from a parent’s incarceration. I respectfully request that the suggestions may be considered as an input for further policy deliberation and consultation. Regards, Prashant Kumar Student & Citizen Contributor

The SOP should ensure that children affected by parental incarceration are identified not only at the time of arrest or prison admission, but also through schools, railway stations, hospitals, Child Helpline and community-level child protection mechanisms. A time-bound referral and follow-up system with a designated case worker should be established so that no child is left without support after identification. The child’s safety, dignity, confidentiality, education, family relationships and best interests should remain at the centre of every intervention.

Draft SOP: Care and Protection of Children of Incarcerated Parents/Guardians 1. Background and Rationale Parental incarceration exposes children to a distinct set of vulnerabilities — emotional trauma, social stigma, disrupted schooling, loss of caregiving, and risk of institutionalisation. Many such children remain invisible in child protection data because their vulnerability arises indirectly, through a parent's arrest rather than any harm to the child directly. A dedicated SOP is needed to ensure early identification and consistent, child-centred response across police, prisons, and child protection systems. 2. Objectives Ensure every child affected by a parent's/guardian's arrest or incarceration is identified at the earliest possible stage. Provide a uniform, rights-based procedure for the care of children living inside prisons with an incarcerated parent, and those living outside with relatives, guardians,
