The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

A Second Chance Childhood Network could bring together Child Welfare Committees, District Child Protection Units, prisons, police, schools, NGOs, counsellors, healthcare professionals and community volunteers to create a coordinated support ecosystem. Trained community mentors could provide periodic, child-friendly support while maintaining confidentiality and avoiding any stigma associated with the parent’s incarceration. A 24×7 child-friendly helpline or dedicated referral mechanism could enable children and caregivers to report urgent concerns relating to abuse, neglect, exploitation, education or mental well-being. Annual district-level reviews should measure outcomes such as school retention, access to welfare schemes, safety, family relationships and rehabilitation, rather than merely counting services delivered.

Children affected by incarceration may face school interruption, financial hardship, stigma or relocation to another caregiver’s home. The SOP should therefore establish an Education Continuity Mechanism that immediately links the child with the nearest suitable educational institution and relevant government scholarships or welfare schemes. A designated teacher or school counsellor could act as a confidential Education Support Mentor without disclosing the parent’s incarceration to other students. Where necessary, support could include school supplies, transportation, digital learning resources, tuition assistance and examination support. Special attention should be given to children approaching board examinations, higher education, vocational training or competitive examinations.

Each district should designate a Child Protection Nodal Officer responsible for coordinating support for children affected by incarceration. For every identified child, a confidential Individual Child Care and Development Plan should be prepared in consultation with the child, caregiver and relevant professionals. The plan may cover education, nutrition, healthcare, counselling, identity documents, financial assistance, housing and protection from exploitation or discrimination. A periodic review mechanism should ensure that the plan changes according to the child’s circumstances. This “One Child, One Care Plan” approach would prevent children from being lost between different departments and help ensure continuous support.

A structured Child Connect Programme should be established in every prison to preserve healthy parent–child relationships wherever this is in the child’s best interests. Prisons could provide child-friendly visiting rooms, age-appropriate recreational spaces and supervised interaction facilities. Where physical visits are difficult, secure video-call facilities should be provided at scheduled intervals. Children should receive counselling before and after visits when necessary, with special arrangements for younger children and children with disabilities. Participation should always consider the child’s wishes, safety and emotional well-being. The programme should also guide incarcerated parents on positive parenting, communication and responsible participation in their child’s development.

Every child affected by parental or guardian incarceration should receive a Child Impact Assessment at the time of admission of the parent to prison. A trained Child Welfare Officer should confidentially assess the child’s living arrangement, education, health, emotional well-being, safety, financial needs and relationship with caregivers. A unique Child Support ID could enable authorized departments to coordinate essential services while maintaining strict privacy safeguards. The system should automatically trigger referrals to Child Welfare Committees, education authorities, healthcare services and social protection schemes wherever required. Importantly, the child should never be labelled or publicly identified because of the parent’s incarceration.

I suggest that the SOP should focus on the basic needs, safety and emotional well-being of children affected by parental incarceration. There should be regular support for their education, healthcare, nutrition and counselling. Children should also be able to maintain safe contact with their parents wherever appropriate. A simple system should be created to identify such children and ensure that they continue receiving support even after leaving prison or when their parent is released. The main focus should always be the child’s safety, dignity and best interests.

To the Government of India, The suggestions I am sharing are related not only to public safety but also to cleanliness, accountability and monitoring. In Delhi and other states, public places should have regulated entry, including reasonable entry fees where appropriate, so that they are not treated as unrestricted open spaces. Clear information about fines for littering, damaging property or creating unhygienic conditions should be prominently displayed. Properly maintained CCTV cameras should be installed at public locations. Places with frequent public access could also consider a Citizen Access Card or similar system to record entry and exit, helping authorities monitor unauthorized access and investigate incidents when necessary. In view of increasing concerns about crime, such measures may be challenging to implement but could strengthen safety, cleanliness and accountability while ensuring citizens' privacy and compliance with applicable laws.
