The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

To ensure the holistic well-being, rights, and dignity of children of incarcerated parents, the best framework requires a coordinated, trauma-informed approach across policing, legal, and child welfare systems Mandatory Arrest-Stage Protocols: Require police to record details of dependent children during arrest memos. If no caregiver is available, immediately refer the child to the Child Welfare Committee (CWC) within 24 hours to prevent abandonment or trauma In-Prison Care (0–6 years): Provide specialized crèches, nutritious diets, vaccinations, and early childhood education within prison premises. Ensure birth certificates do not state "born in prison" to prevent lifelong social stigma Smooth Transition & Kinship Care: Prioritize placement with extended family or vetted foster care over institutionalization when a child turns six or if parents are incarcerated. Provide financial sponsorship to surrogate caregiver Preserving Parent-Child Bonds: Implement a "Child Connect" pro

Children of incarcerated parents should receive proper support for their education, healthcare, nutrition, safety, and emotional well-being. The SOP should ensure regular monitoring, counselling, protection from stigma and discrimination, and coordination among child protection authorities. All decisions should prioritize the child’s safety, dignity, and best interests.

To ensure the care and protection of children of incarcerated parents, India requires a compassionate, system-wide framework. First, law enforcement must mandate the identification of minor dependents at the time of arrest and inform the Child Welfare Committee within 24 hours to prevent neglect. Placements should prioritize vetted kinship care or foster families over institutional orphanages, backed by regular welfare audits. To shield these children from social stigma, state policies must guarantee uninterrupted schooling, financial support, and strict privacy regarding parental incarceration across school records. Trauma-informed mental health counseling must be integrated into local health centers to help them process emotional distress. Furthermore, prisons should replace harsh barriers with child-friendly visitation areas and regular free video calls. Finally, for children living with incarcerated mothers, a smooth transition with complete health records and Aadhaar enrollment mu

The SOP should adopt a child-centered and rights-based approach, ensuring that children affected by parental or guardian incarceration are not treated differently or stigmatized because of the circumstances of their parents. A clear mechanism should be established for early identification and registration of such children, followed by regular assessment of their safety, health, education, emotional well-being, and basic needs. Each child should have access to counseling, healthcare, education, nutrition, legal assistance, and rehabilitation services through coordinated efforts of prisons, Child Welfare Committees, District Child Protection Units, schools, police, and NGOs. Special arrangements should be made for children living with incarcerated mothers, including safe living conditions and age-appropriate facilities. The SOP should also ensure regular monitoring, family support, confidentiality of children's information, and a simple grievance-redressal system.

Protecting child rights, ensuring their safety and empowerment is essential for building a better and stronger society. Every child deserves a safe, happy, healthy, and dignified childhood, regardless of their background or circumstances. The National Commission for Protection of Child Rights plays an important role in creating awareness, protecting children from abuse, exploitation, child labor, discrimination, and other forms of harm. It is inspiring to see efforts focused on giving children equal opportunities to learn, grow, and achieve their dreams. We must all contribute by listening to children, respecting their rights, supporting their education, and creating an environment where they feel safe and valued. Every child has potential, and every child deserves a chance to shine. Together, we can build a future where every child is protected, respected, empowered, and given the opportunity to live with dignity and hope.
