The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

I welcome the Draft SOP. Detailed suggestions with rationale and formats (Annexures A and B) are in the attached enclosure. Key suggestions: (1) Widen the CoIP definition to include children living without adult care, in child-headed households, or whose whereabouts are unknown; conduct a baseline assessment in all prisons within 60 days, with DCPU tracing within 30 days. (2) Replace "Child line" with "Child Helpline" throughout. (3) Prescribe a standard format for the Independent Monitor's quarterly visits (Annexure A). (4) Add procedures for child-headed households, arrest and court stages, inter-state CWC coordination, and reunification after release. (5) Make CNCP declaration a last resort; prefer kinship and foster care over CCIs. (6) Give the monitor powers of unannounced visits and add an independent grievance mechanism. Focus on Prison Visitation & Child Psychology Suggestions for SOP – Focus on Child Psychology & Prison Contact: Child-Friendly Visitation Spaces: Replace traditional glass partitions/bars with designated, non-intimidating visitation rooms inside prisons. E-Mulaqat & Tele-Visits: Mandate weekly high-speed video call facilities reserved specifically for incarcerated parents and their minor children. Trauma-Informed Counseling: Provide specialized mental health counseling for children through certified child psychologists to manage trauma and separation anxiety. Sensitization of Prison Staff: Train prison personnel and visiting staff on child-sensitive interaction protocols during visits. Pre-Release Reunification Plan: Develop structured counseling and reintegration roadmaps 3 months prior to a parent’s release to ensure smooth family reunification.

Focus on Legal Aid & Civil Rights Suggestions for SOP – Focus on Legal Rights & Institutional Governance: Mandatory Rights Disclosure: Require law enforcement to log dependent children at the time of arrest and inform guardians of child rights under the JJ Act. Legal Representation & Advocacy: Assign free legal aid to assist caretaking relatives in securing guardianship, welfare scheme enrollment, and birth documentation. CWC Oversight: Mandate automatic notification to local Child Welfare Committees (CWCs) upon parental incarceration to oversee child safety without police intervention at home. Data Privacy & Anti-Stigma: Prohibit public disclosure or institutional tagging of children’s parental background in school or community records to prevent social discrimination. Periodic Inter-Agency Review: Establish quarterly coordination meetings between Prison Authorities, DLSA, and DCPUs.

Focus on Educational & Financial Support Suggestions for SOP – Focus on Education & Financial Welfare: Uninterrupted Schooling: Guarantee direct enrollment in nearby Kendriya Vidyalayas or state government residential schools, waiving document requirements. Direct Financial Assistance: Provide immediate monthly child support grants under Mission Vatsalya to non-incarcerated caregivers/relatives to prevent destitution. Sponsorship & Foster Care: Create streamlined pathways for Kinship Care sponsorship, funding extended family members who take in affected children. Learning Continuity Support: Supply free textbooks, uniforms, learning devices, and local tutoring support through District Child Protection Units. Skill Training for Older Youth: Offer vocational training and higher education stipends for older children aging out of care systems while parents remain incarcerated.

A Second Chance Childhood Network could bring together Child Welfare Committees, District Child Protection Units, prisons, police, schools, NGOs, counsellors, healthcare professionals and community volunteers to create a coordinated support ecosystem. Trained community mentors could provide periodic, child-friendly support while maintaining confidentiality and avoiding any stigma associated with the parent’s incarceration. A 24×7 child-friendly helpline or dedicated referral mechanism could enable children and caregivers to report urgent concerns relating to abuse, neglect, exploitation, education or mental well-being. Annual district-level reviews should measure outcomes such as school retention, access to welfare schemes, safety, family relationships and rehabilitation, rather than merely counting services delivered.

A child should never have to repeatedly explain their family’s pain to prove that they deserve help. I suggest that the SOP introduce a “No Repeat Disclosure” principle. Once a child affected by parental/guardian incarceration is identified, essential welfare information should be securely shared between the authorised child-protection, education, health and welfare authorities on a strict need-to-know basis, with strong confidentiality safeguards. The child should not have to repeatedly narrate the parent’s incarceration, family circumstances or personal difficulties to every department. At the same time, the child’s voice should remain central: protect age-appropriate consent, participation, and the right to correct or refuse unnecessary information. The system should make the child feel supported, not processed. Sometimes protecting a child’s dignity means asking them to tell their story only once. This small procedural change could make the SOP more humane, coordinate

I suggest introducing a confidential “One Child – One Support Plan” for every child affected by the incarceration of a parent or guardian. The plan should include early assessment of education, health, nutrition, emotional well-being, safety, caregiving and financial needs. A designated Child Protection Officer should coordinate with the Prison Department, Child Welfare Committee, education and health authorities to ensure continuous support. The SOP should prevent school dropout, child labour, neglect, trafficking and unsafe caregiving while ensuring access to education, healthcare, nutrition, identity documents and eligible government schemes. Safe family contact should be facilitated wherever appropriate, and children should be heard in decisions affecting them. Strict confidentiality must protect children from stigma and discrimination. Regular follow-up, emergency referrals and post-release reintegration support should also be included.

Some Suggestions from my side 1.Purpose: Ensure the safety, care, dignity, education, health and overall well-being of children whose parent(s) are incarcerated. Prevent children from being neglected, abandoned, trafficked or institutionalised unnecessarily. 2. Education Ensure children continue schooling without interruption. Assist with school admission, documentation, uniforms, books, scholarships and other educational needs where required. 3. Psychosocial Support Provide counselling and age-appropriate emotional support. Avoid stigmatising children because of their parent's incarceration. 4. Contact With the Incarcerated Parent Facilitate safe and child-friendly visits, telephone/video calls or other appropriate communication. Consider the child's wishes and best interests. Ensure visits do not expose children to unsafe or distressing situations.
