The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

To the NCPCR,  I submit these inputs for the SOP on Children of Incarcerated Prisoners, focusing on the Indian reality where stigma often begins within extended families.  1. Strict Kinship Vetting: The CWC must never automatically place children with relatives. Mandatory bias audits must precede placement to prevent domestic abuse. 2. Foster Care & Hostels: Expand state-funded, non-kinship foster care and secular group hostels to offer safe alternatives away from judgmental relatives. 3. Automated Alerts: Mandate child-status logging at arrest, triggering immediate DCPU/CWC welfare tracking. 4. Safe Parent Contact: Replace grim prison bars with child-friendly visiting zones and provide free weekly video calls. 5. Strict Oversight: Conduct monthly, unannounced private interviews with children in kinship care to check for hidden discrimination or forced labor.

Children should not bear the social, emotional, educational, or developmental consequences of a parent’s incarceration. When a parent is imprisoned, children may face stigma, bullying, social exclusion, financial hardship, disrupted education, emotional distress, and weakened family support, despite having no responsibility for the circumstances that led to the parent’s incarceration. These challenges can adversely affect their sense of dignity, belonging, safety, and future opportunities. Therefore, there is a need for a comprehensive, child-centric approach that goes beyond conventional counselling and welfare measures. The proposed framework seeks to strengthen privacy protection, prevent discrimination and bullying, facilitate meaningful peer and community inclusion, provide accessible support mechanisms, and ensure continuity of education and development. The approach should focus on supporting the child without labelling or publicly identifying them because of their parent’s circ

Proposed Pilot Initiative A pilot programme may be initiated in selected districts through collaboration among NCPCR, the concerned State Commission, prison authorities, District Child Protection Units and IPH&H. The pilot may combine health assessment, counselling, life-skills education, first-aid training, career guidance and vocational orientation. Its outcomes may be independently evaluated before wider implementation. The guiding principle of the SOP should be clear: a child must never be punished, labelled or denied opportunity because of the conduct or legal status of a parent or guardian. This is a suggestion by Fairfield & IPH&H Group of Institutions. We are n affiliated college of GGSIP University and NAAC Accredited college in Delhi.
