The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

Child-first approach: Every decision should prioritise the child’s best interests, dignity and safety. Privacy by design: Protect identity, photographs, records and personal information from unnecessary disclosure. Zero stigma: Prevent discrimination against children because of a parent’s incarceration. Continuity of education: Ensure uninterrupted schooling, scholarships and learning support. Emotional support: Provide regular counselling and trusted adult mentorship. Digital safety: Ensure secure digital records and age-appropriate digital literacy. Future-ready children: Include career guidance, life skills, vocational training and financial literacy. Safe family connection: Facilitate secure and child-friendly communication with incarcerated parents. Voice of the child: Give children a safe opportunity to express their needs and concerns. Accountability: Establish regular monitoring, grievance redressal and independent child-safety reviews.

The policy should ensure the safety, dignity and privacy of children of incarcerated parents. It can include: Strict confidentiality of children’s personal, educational and family information. Secure digital records with access limited to authorised child-protection officials. Prohibition on publicly identifying children or sharing their photographs without appropriate consent and safeguards. Child-friendly counselling and grievance mechanisms. Safe facilities for communication with parents without exposing sensitive information. Regular privacy and child-safety audits in institutions. Training for prison and welfare staff on data protection and confidentiality. Clear procedures for reporting and responding to privacy breaches. Special protection from stigma, discrimination and social labelling.

The policy can introduce long-term support systems to help children of incarcerated parents build a secure and independent future. Key measures may include: A dedicated Child Support Card to track education, health and welfare services. Mentorship programmes connecting children with trained volunteers and educators. Career guidance and scholarship programmes from secondary school onwards. Life-skills, financial literacy and digital-safety education. Safe communication facilities to maintain healthy contact with parents. Emergency financial assistance for vulnerable families. Community-based support centres offering counselling, tutoring and activities. Periodic review of each child’s progress by child-protection authorities.

The policy should focus on the overall development and future well-being of children of incarcerated prisoners. It can include: Free and continuous access to quality education and digital learning. Regular health check-ups, nutrition and mental-health counselling. Skill-development and vocational training for older children. Safe housing, foster care or family support when required. Scholarships and financial assistance for education. Sports, arts and recreational activities for personality development. Regular monitoring to prevent neglect, discrimination and exploitation. Individual development plans based on each child’s age, needs and interests.

Establish 'Bachpan Mulakat Kendras' inside jails - a separate colorful room with toys, books and female staff where children can meet their incarcerated parents. Current jail environment is traumatic for a child. Child-friendly meetings will protect their mental health and preserve the parent-child bond.

Strict confidentiality protocol in schools. The child's identity as 'child of prisoner' should never be disclosed to classmates. Appoint a dedicated Child Welfare Officer in each district to provide monthly counseling, mentorship and financial aid for school fees and uniforms without any stigma.

Create a 'Bal Suraksha Card' and a confidential tracking portal for every child affected by parental incarceration. This card should auto-link the child to ICDS, RTE education, Ayushman Bharat health, and counseling services, ensuring no child drops out of the welfare system due to parent's imprisonment.

The SOP should ensure that children of incarcerated prisoners are not stigmatized. Their education should continue in regular schools, with counseling support and financial assistance. Regular meeting with parents in a child-friendly environment should be allowed. Government should link them with foster care or child welfare homes if no guardian is available, and ensure their Aadhaar, health and nutrition needs are protected with dignity.
