The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

Children are the most vulnerable in this situation. Overcrowded and lack of desired amenities to children is a big problem. Minimum basic requirements are not fulfilled to children as citizens of India.

Children should not suffer because their parent or guardian is in prison. The SOP should ensure early identification of such children and provide support based on their individual needs. Education should continue without interruption, with help for school admission, books, fees and scholarships where required. Children should have access to counselling, healthcare and emotional support in a safe and respectful environment. Where safe and appropriate, children should stay with trusted family members and maintain contact with their incarcerated parent through child-friendly visits, phone calls or approved digital communication. Their identity and personal information should remain confidential to prevent stigma, bullying and discrimination. Prisons, Child Welfare Committees, District Child Protection Units, schools, healthcare and legal authorities should work together through a clear support and monitoring system. Regular follow-up should ensure the child remains safe, supported.

Care and Protection of Children of Incarcerated Prisoners Respected Government, children should not suffer because of the actions or circumstances of their parents. When a parent is in prison, children may face problems such as lack of proper care, education, nutrition, safety and emotional support. The government should take special steps to protect these children and ensure that they can live with dignity. I suggest that every such child should have access to free education, nutritious food, healthcare and a safe living environment. The government can provide financial support and scholarships for their education. Regular counselling and emotional support should also be available to help children deal with stress and loneliness. Children living with an incarcerated parent should be provided a clean, safe and child-friendly environment. Their privacy and dignity must be protected.

Formulate a structured 90-day pre-release reintegration plan that includes family counseling to prepare children for their parent's return and minimize domestic disruption.

Namaste bharat.. I suggest introducing a confidential “Child Protection Passport” for every child affected by parental or guardian incarceration. It should record only essential welfare needs such as education, health, nutrition, emotional well-being, caregiver support, safety and eligible government benefits. Along with this, a “One Child–One Support Plan” should identify each child’s needs, assign a responsible department, set a follow-up date and track the outcome. A secure coordination mechanism among Prison, Child Protection, Education, Health and Social Welfare authorities can prevent children from being overlooked or repeatedly asked to explain their circumstances. An early-warning system should identify school dropout, unsafe care, financial hardship or protection risks before they become crises. Strict privacy, child participation, safe family contact and post-release reintegration support should be ensured.

following are myinputs. 1. the law and order shall be impartial, thorough , should think handed and one times before giving judgment in case of child incarceration. 2. Else future of the child will be spoiled/effected 3. Morality of the child will be degraded and their friends morality will be effected 4. it will lead to vexing of citizens 5, one child/ youth effected/demoralised means , it is loss of resource to the nation 6. hence before arresting of sentencing care should be taken
