A Working Group was constituted by the Ministry of Corporate Affairs under the Chairmanship of Mr. N.K.Bhola, Regional Director (North), MCA with a mandate to deliberate and submit its recommendations on rules and regulations and other related matters for the insolvency and liquidation process under the Insolvency and Bankruptcy Code, 2016. This Working Group had earlier developed draft regulations for Corporate Voluntary Liquidation Process. Based on these drafts and after considering public comments on the same and following the due process, the Insolvency and Bankruptcy Board of India (Board) has notified the Insolvency and Bankruptcy Board of India (Voluntary Liquidation Process) Regulations, 2017 on 31st March, 2017.

This Working Group has now submitted the draft regulations for Fast Track Corporate Insolvency Resolution Process of Corporate Persons. These regulations shall apply to such Corporate Debtors with assets and income below a certain level or such class of creditors or such amount of debt or such categories of Corporate Persons, as may be notified by Central Government under section 55 (2) of the Insolvency and Bankruptcy Code. The resolution process under Fast Track Regulations shall be completed within a period of 90 days from the insolvency commencement date and can be extended by 45 days with the permission of Adjudicating Authority under certain circumstances.

Under section 55 (2) of the Code, the Central Government may notify such categories of Corporate persons on which the Fast Track Corporate insolvency resolution process regulations shall be applicable. The working group has suggested three categories of corporate persons for applicability of Fast track regulations i.e. Small companies, as defied under subsection (85) of section 2 of Companies Act.,2013, Companies/LLP which has borrowed money not exceeding Rs. 2 crores and Start-ups as defined in DIPP notification no 180 (E) dated 17.02.2016.

It has been decided to to invite public comments on the draft regulations on fast track resolution and Eligible Corporate persons. Accordingly, comments on each provision of the draft regulations are invited. The draft regulations are available on MyGov here. The last date for submission of suggestions is 8th May, 2017.

Hai sir, my bsnl landline number 04343 268428 was subscribed by my grandfather 15 years ago, now 1. It is not working since 2YEARS, 2.Every month bill is being paid 3.Not even a single outgoing or incoming call since more than one year. 4.Repeatedly complained through IVRS-- Vain 5.Nearly 20 connections surrendered in my village for same reason. ...Now I challenge-- You will not make INDIA DIGITAL without issue like this being rectified,,

In Tamilnadu the life of common man has become horrible..1)No Law and order and daily large number of protests, dharnas,etc are conducted, many murders are committed, goondas raj is prevailing, 2)Police is acting as per political directions, 3) No stable government to look after the welfare of people,4)ruling party has no time to stabilise themselves, to get back the Old party symbol (two leaves) since common lay men know only that symbol, 5)prices are not under control, medicines are soaring .

Sir,I am proud on the decision to remove the flash lights from the vehicles as well as most of the dignitaries,ministers are using the excess vehicles in their journey due to this a large number of machinery of govt.,fuel and employees used by them in protocol.In this regard rules may kindly be amended for VIP,s protocol to save the unnecessary machinery of govt.and mostly several vehicles can be seen on roads who are using hooters and officers in the different vehicles in a queue.Kindly van it.

Modi Ji, please request all sales tax department executives to visit regularly to all shops (irrespective of business) and verify are they migrated to Digital India. We have to utilize public servants effectively. We should implement IT companies policy to get the project done on time.. else respective public servant / department should pay fine. Fine should be deducted from their salary.

Modi Ji, why don't government directly tie up with all top notch IT companies in India to increase awareness of Digital India, Science & Technology in Rural India? I will not recommend NGOs to do this activity.

Sir, There is a need to simplify the process of liquidation with strong back up for recovery. Today those people with bad intention should be penalise. After longer period of time huge amount not recovered due to complex process those people are escape from that place.
