The draft 'Central Excise Bill, 2024' introduced by the Central Board of Indirect Taxes & Customs is a significant and forward-looking initiative aimed at revamping the existing legal framework governing central excise duties in India. This Bill serves as a crucial step towards modernizing the tax laws related to excise duties, with an overarching objective of streamlining processes, enhancing compliance, and fostering a conducive environment for business operations.
One of the key highlights of the proposed Bill is its intent to replace the outdated Central Excise Act of 1944. By doing so, the government is signaling its commitment to aligning the excise duty regime with contemporary economic realities and international best practices. This move is imperative to ensure that the regulatory framework remains relevant and responsive to the evolving needs of the industry and the economy as a whole.
The emphasis on promoting ease of doing business is a laudable aspect of the Bill.
Revenue comes when the company is operating at a profit.
But companies ask where the tax collectors are going even when they are making losses. An insurance scheme should be implemented for excise duty paying companies. A minimum amount should be provided to companies that have incurred losses. Excise duty collection companies also require an insurance policy, just as ATM card holders are required to provide accidental death insurance. The scheme should provide minimum wages (for 3 months) & settlement amount to loss making workers. An insurance scheme should be developed to provide rehabilitative training for company employees and provide funds for operation and maintenance of companies for a period of 3 months.
The insurance premium for them should be paid from the excise duty collected from the companies.
This will show that the government cares about the tax collecting companies.
Some companies claim that the government is profiting in the name of taxes without any effort.
