In order to engage with the stakeholders and invite comments from the public at large, the Department of Revenue has decided to make available the draft Model Laws on Goods and Services Tax (GST) in the public domain.

There are two Model Laws on GST which are being put up in the public domain. This discussion pertains to the draft Model Goods and Services Tax Law for the Centre and the States. The draft law can be seen here. You are invited to submit your comments/feedback on the draft law through this discussion on MyGov.in.

To facilitate the analysis of the comments / feedback, you are requested to add a hashtag to your comments. The hashtags should be added using the following scheme:

Use the hashtag #ModelGSTChap1 for comments pertaining to Chapter 1 of the Model GST Law, #ModelGSTChap2 for comments pertaining to Chapter 2 of the Model GST Law, etc.

In case you have more than one suggestion to offer, you may find it convenient to type out your comments in a separate document, with hashtags specifying the Chapters for which the comments are being given. This document can be converted into a PDF and uploaded in the discussion thread.

It is our humble prayer with our favorite Prime Minister of India to consider these suggestion/or representation to enact the Tax Practitioners Law in India to safe guard the interest of Indian Govt. Dear Friends, I have derived the ideal quotations, PI, Delivery note & Tax Invoice. PFA the sample with Buyer Billing Name and Add, Sellers Billing Name and Address, Buyer Delivery Name and Add, Buyer and Seller's contact details and TIN Number. Kindly make such ideal Tax Invoice formats for the entire country to follow. This would make software companies implement it at their level. Easier for the seller, buyer and tax man to identify the goods and services easily. Satyan

PFA the sample of a quotation, DC, tax invoice. With the pictures, it would be easy for the seller, buyer and the tax man to check the articles. Buyer Seller details. Making such model invoices even as a suggestion all the accounting software companies would follow the same.

There are 3 possibilities a) exporting state b) importing state c) warehouse state. Means 3 TIN Numbers. The GST paid should go to an escrow account where it automatically divided into the set ratio of the centre, state and local body. The taxpayer pays only to one bank account with 3 TIN numbers. What about a provision on delivery on a Challan / Delivery Note / Sending goods for a trail or a demo? What about Sales Return / Goods Return? What about movement of goods for repairs?

Ever since VAT was implemented "Disallowance of VAT Credit" because of cross-tallying of Input VAT Credit details vis-a-vis data uploaded by issuer of Output VAT Bills has caused enormous problems & this is know only at time of assessment This can be overcome by uploading the VAT Details online by issuer of Bill & Credit being available only to the extent of the VAT Details uploaded similar to 26AS TDS Credit. All registered persons must be issued a GST Regn. Card similar to PAN Card

#ModelGSTChaplll On one hand it is advocated as game changer on the other hand the thresh hold limits are obnoxiously low. Have you forgotten the 10 lacs missing assesses of service tax, most of which have surrendered registrations but are being shown active. By keeping low threshold limit you are incentivising rampant corruption on both sides by the Department and by the Trade. Rs.10 lacs means sale of about Rs. 3,100/- per day for about 325 days. Does it make any sense?

#ModelGSTChap1 - the definitions of business, casual taxable person, consideration, continuous supply of goods, continuous supply of services, location of recipient of service or location of supplier of service, non -resident taxable person are nothing but imaginations of the erstwhile service tax officers, that were provided under Rules, otherwise have been settled, thus have been enacted in the Act itself. Shocking a complete case of mistrust by Gov.

#ModelGSTChap1Its classic piece of legislation created on the basis of the assumption that the States do not know Service Tax & Central Excise and Central Authorities do not know taxing of Goods. If this is the basis then I am afraid you would have to sack your entire team of Bureaucrats. After all you have appointed cream of officers from 'Indian Revenue Services' and not novices.
