In order to engage with the stakeholders and invite comments from the public at large, the Department of Revenue has decided to make available the draft Model Laws on Goods and Services Tax (GST) in the public domain.

There are two Model Laws on GST which are being put up in the public domain. This discussion pertains to the draft Model Goods and Services Tax Law for the Centre and the States. The draft law can be seen here. You are invited to submit your comments/feedback on the draft law through this discussion on MyGov.in.

To facilitate the analysis of the comments / feedback, you are requested to add a hashtag to your comments. The hashtags should be added using the following scheme:

Use the hashtag #ModelGSTChap1 for comments pertaining to Chapter 1 of the Model GST Law, #ModelGSTChap2 for comments pertaining to Chapter 2 of the Model GST Law, etc.

In case you have more than one suggestion to offer, you may find it convenient to type out your comments in a separate document, with hashtags specifying the Chapters for which the comments are being given. This document can be converted into a PDF and uploaded in the discussion thread.

Congratulations to Union Government. Appreciating the dynamism in publishing the draft Model GST law prepared by CBEC in association with All State Commercial Tax Departments in the nation and inviting suggestions. We find some inadequacies for a due place for sales tax/VAT Act practitioners which is available under existing KVAT Act, 2003/all other state tax laws which is proposed to be subsumed. Please do not neglect this fraternity to become unemployed, shelter-less to avoid hue & cry after.

We welcome & congratulate Union Government, CBEC and All State Commercial Tax Departments initiating to enact GST in the nation and releasing a Model Draft Law in this regard. Appreciating the dynamism in making the draft law published and inviting suggestions, we find some inadequacies for a due place for sales tax/VAT Act practitioners which is available prevailing under existing KVAT Act, 2003 and in all other state laws which is proposed to be subsumed.Please do not neglect this fraternity.

Welcome Central Government initiative for development #GST:In the proposed GST it is seen scope for CA`s & Court Advocates. We provide regular assistance to Sales Tax & Income Tax Practitioners to upload data and file regular returns with audit reports. These Tax practitioners should be continued in the GST to retain our employment opportunity. We are not in a position to changeover to CA`s or Advocates for assistance mainly of small business people. This may kindly be properly taken care in GST

We have provision under Section 14 for change of tax rates for supply of services, do we have similar provision for supply of goods also ? Say i have received an advance on 14th April for Rs 10,000 and applicable tax rate is Rs 18%, the goods are being sent on 5th June and the value of supplies is Rs 50,000, the applicable tax rate is 19%, for this supply what should be the tax rate. The GST Rate has changed to 19% from 1st June. for Rs 10,000 @ 18% for balance Rs 40,000 @ 19% for total sup

how do i take in the input tax credit on goods shipped one or two days prior to the appointed date ? those purchases will not be part of my return and a credit is not shown in that, how do we handle this ?

GST on advance receipt - how to treat GST if i need to return the advance to my customer ? At the time of receipt of Advance, charged tax and issued a tax invoice but latter on for some business reason need to return the same, do we need to issue any document or pay only the net amount

Purchase Return / Sales Return - in the case of Purchase or sales return, do we need to link to the original transaction and taxes to be brought from there or treat it as new supply and levy tax on it and issue tax invoice ?

Though this community always busy striving for the sake of bread& butter work like ants in serving all needs of the tax payers but remain unorganized since they lac due governance by Independent statute hence least cared. Requested not to neglect this community become burden on the society. Recognize them with independent statute & prominent role in forthcoming GST & existing IT
