In order to engage with the stakeholders and invite comments from the public at large, the Department of Revenue has decided to make available the draft Model Laws on Goods and Services Tax (GST) in the public domain.

There are two Model Laws on GST which are being put up in the public domain. This discussion pertains to the Integrated Goods and Services Tax (IGST) Law for the Centre which relates to Goods and Services tax on supplies in the course of inter-State trade or commerce. The draft law can be seen here. You are invited to submit your comments / feedback on the draft law through this discussion on MyGov.in .

To facilitate the analysis of the comments / feedback, you are requested to add a hashtag to your comments. The hashtags should be added using the following scheme:

Use the hashtag #IGSTChap1 for comments pertaining to Chapter 1 of the IGST Law, #IGSTChap2 for comments pertaining to the Chapter 2 of the IGST Law, etc.

In case you have more than one suggestion to offer, you may find it convenient to type out your comments in a separate document, with hashtags specifying the Chapters for which the comments are being given. This document can be converted into a PDF and uploaded in the discussion thread.

Introducing GST is game changers & welcome step towards ease of doing business. I suggest provision should be made for waiver tax on of inputs for export products or based on the value of the export a company has achieved durng the FY. OR Exporter should be credited back the GST amount in his linked bank account. withour any further documentation. Especially Small & medium size exporters face lot of difficulties with Govt authorities to prove and request the refunds & time is lost

Dear Sir, I would request you to implement Tax deduction / collection at source when you introduce the GST. This would improve collection and avoid delays. The vendors will be free of penalties which occurs due to delay in payments to them including the tax components. Pls formulate a TDS kind of a system where the payments made to the tax authorities on behalf of the vendor can be indicated through a challan & which will be used to reconcile at the end of the month / quarter / year.

38 Refund of Tax , Para (5) mention's that proper officer shall issue the refund order within 90 days . Sir this is to be modified to 8 days as your goodself will understand that the working fund's of Exporters will be blocked for more than 90 days.This will reduce the working capacity of the Exporter's

Suppose i m manufacturing an item. Now, This item requires raw material. The person who is supplying Raw material is already paying required minimum tax. He has given me in proof that he is already paid required tax. Now, after taking the submission, i start manufacturing . Now, there should not be any excise duty or any other tax liability on me because this person has given the product inclusive of all taxes.Further, i transport & distribute it to end user, this chain should nontaxable.

Successful GST should keep 3 pillars of success intact - 1) simplify compliance 2) nil dispute on jurisdiction or valuation 3) automation of seamless input credit with no blocker provisions State and centre should enforce compliance by being strict to habitual offenders but should not harress all for mistake of few. Provisions like hold of input credit for default by one vendor will put all his customers under stress who has been supplied goods or services by him. Quick redressal is key.

Even if the NDA's GST law is passed, things won't change much and NM won't see huge increases in FDI or domestic investment. This is because the looting of the poor and lower middle classes will continue in the new GST regime. If NM really wants to attain his $10-20 trln GDP dream then he must drastically cut the excise/service tax or GST rates. Else, the economy will keep crawling along at 7% growth rate.
