TDS on Sale of Property
महोदय 50 लाख या अधिक मूल्य की, जो प्रॉपर्टी 31 मई 2024 से पहले बेंची/खरीदी गयी है एवं यदि 31 मई 2024 तक जानकारी के अभाव के कारण seller (विक्रेता) का पैन -आधार यदि लिंक नही हो सका था और बाद में जानकारी होने पर विक्रेता यह लिंकिंग शुल्क जमा करके करा लेता है एवं प्रॉपर्टी का खरीददार 1% दर से प्रॉपर्टी टीडीएस 26QB चालान से जमा कर देता है, तो केवल इस आधार पर कि यह लिंकिंग 31 मई 2024 के बाद हुई है, क्रेता को इनकम टैक्स विभाग द्वारा यह नोटिस भेज देना कि यह टीडीएस 1% के बजाय 20 गुना अधिक यानि कि 20% दर से जमा किया जायेगा, कहाँ तक जायज है ?
यदि भूलवश क्रेता को टीडीएस नियम की जानकारी नही थी एवं उसके द्वारा बिना टीडीएस काटे पूरा भुगतान विक्रेता को कर दिया गया था, तो स्थिति और भी भयावह हो जाती है, क्यूंकि इस स्थिति में 20 गुना टीडीएस ब्याज एवं लेट शुल्क के साथ क्रेता को अपनी जेब से जमा करना होता है |For eg यदि actual टीडीएस 1 लाख था तो अब क्रेता को 20 लाख (प्लस ब्याज-लेट फीस) अपनी जेब से केवल इस कारण से जमा करने पड़ेंगे, क्यूंकि विक्रेता का पैन-आधार लिंक नही था |

Bring major changes in Indian taxation system. GST based indirect taxation is a step in right direction. But direct tax on Income is slowing down the growth of Indian economy. Reason being, it is unable to bring major population under tax bracket. While, certain section of society is paying double taxation. Our economy will see a big boost if direct taxation on income is completely abolished. This will increase the purchasing power of middle, upper and rich class. Government can makeup for this shortfall by introducing a nonlinear rational GST based indirect taxation system. Every item which the citizens buy or need, come in variety, from very cheap to very expensive. Why not categorize all items according to their price and make the lowest band items with minimal or no GST. The GST then should increase nonlinearly as price approaches the upper band. The logic is, people may hide their income to escape direct taxation, but remember, everyone earns to make a good living! Good Luck GOI.
