Ministry of Communications had initiated a public consultative process to develop a modern and future-ready legal framework in telecommunication.

With 117 crore subscribers, India is the world’s second largest telecommunication ecosystem. The telecommunication sector employs more than 4 million people and contributes about 8% of the country’s GDP.

The existing regulatory framework for the telecommunication sector is based on the Indian Telegraph Act, 1885. The nature of telecommunication, its usage and technologies have undergone a massive change since the era of “telegraph”. The world stopped using “telegraph” in 2013.

In the past eight years, the Government has taken several initiatives for the growth of the telecommunication sector. It is in this context that we have taken up the initiative to restructure the legal and regulatory framework for the telecommunications sector.

The Bill will replace the existing legal framework governing telecommunication in India, comprising of the Indian Telegraph Act, 1885, the Wireless Telegraphy Act, 1933 and the Telegraph Wires (Unlawful Possession) Act, 1950.

In July 2022, a Consultation Paper on ‘Need for a new legal framework governing Telecommunication in India’ was published and comments were invited. Comments have been received from various stakeholders and industry associations.

Based on the consultations and deliberations, the Ministry has now prepared the draft Indian Telecommunication Bill, 2022. To facilitate further consultations, an Explanatory note to provide a brief overview of the Bill has also been prepared.

Citizens are invited to share their comments on the Draft Indian Telecommunication Bill 2022 on the MyGov Platform.

The government has released the draft of ‘The Indian Telecommunication Act, 2022 wherein it has proposed several significant changes, including provisions for waiving off dues for financially stressed operators, bringing over-the-top platforms (such as WhatsApp, Zoom, Netflix) within the ambit of telecom services that require a licence to operate and provisions for message interception in case of public emergency. tcontinues to provide telecom services and does not default on payment of dues. However, if the entity is unable to comply, then the assigned spectrum will revert to the control of the government. It “also seeks to create disincentive for acquiring spectrum at a value lower than auction-determined price. The draft Bill has proposed a refund of fees in case a telecom or Internet provider surrenders its licence. The Bill also expanded the definition of “telecommunication services" to include broadcasting services, e-mail, video and data communication services.

भारत संचार निगम ने देश के हर शहर कस्बे और गांव में पहले टेलिफोन के लोहे के खम्भे लगाए थे, फिर केबल बिछाए जाने पर उन्हें कहीं से भी उठाया नहीं गया। सड़कों, जंगलों और नालियों में अरबों रुपए के लौह धातु के खम्भे सड़ रहे हैं। केबल बिछाने के उपरांत सैल्युलर कुनैक्शन दिए गए तो केबल को नहीं उठाया गया और इस प्रकार करोड़ों की केबल विभाग/निगम के अधिकारियों की लापरवाही से बर्बाद हुई और कुछ चोरी हो गई। आज भी ऐसी सम्पत्ति को नष्ट होते हुए यत्रतत्र देखा जा सकता है। इस खराब हो रही लौह धातु और केबल्स को इकट्ठा करवाकर इसका सदुपयोग सुनिश्चित किया जाना चाहिए।

Telecommunications should be like social media. It is a tool to contain theft dacoity robbery terrorism eve teasing. So police can use it. The Navy Air force Army can use it. It can be used in teaching. For student teacher relation. For deciding in corporate affairs. For Government decision making. For municipal decision making. For signalling and forecasting. It is helpful for Railways. For Meteorological announcement. We have to develop the telecommunications in such a manner that it becomes the backbone in our development as a cheap mode of communication. The social media needs much educational background. But telecommunications can be a tool or ware of the masses . Let us make it easy. Easier.

Namaste ji. A separate uniform mobile networks needed for the Government offices for the security of Government matters. Mobile networks must take responsibility for the uninterrupted service. A separate Grievances Platform may be started for to get Monthly feedback. It'll give more confidence to the users. According to the Grievances the Government officials may give directions to the Mobile networks for smooth service to the users. Jai Hind.

Namaste ji. Now we are living in Digital India. More Apps available for various activities through online. Only Government Departments are using Government Telecommunications. Telecommunication Divisions of Government need to be Updated. Training about the Updated Technology is very much needed for Technical Staff . Jai Hind
