Brief Background of the Real Estate Act, 2016

The Real Estate (Regulation and Development) Bill was passed by the Rajya Sabha on 10th March, 2016 and by the Lok Sabha on 15th March, 2016. The Bill as passed by the Parliament was assented to by the Hon’ble President on 25th March, 2016. The Real Estate (Regulation and Development) Act, 2016 was published in the Official Gazette on 26th March, 2016 for general information. The Real Estate Act, 2016 aims at protecting the rights and interests of consumers and promotion of uniformity and standardization of business practices and transactions in the real estate sector. It attempts to balance the interests of consumers and promoters by imposing certain responsibilities on both. It seeks to establish symmetry of information between the promoter and purchaser, transparency of contractual conditions, set minimum standards of accountability and a fast-track dispute resolution mechanism.

Brief Background of the Draft Rules under the Real Estate Act, 2016

Specified sections of the Real Estate (Regulation and Development) Act, 2016 have come into effect from 1st May, 2016, including section 84 of the Act which provides that “the appropriate Government shall, within a period of six months of the commencement of this Act, by notification, make rules for carrying out the provisions of the Act” i.e. by 31st October, 2016. As per section 2(g)(i) of the Act, the Ministry of Housing & Urban Poverty Alleviation is the appropriate Government for Union Territories without Legislature.

In this regard, the Ministry has prepared the draft Rules on which the Ministry proposes to elicit general comments through the open forum for discussion on the MyGov portal.

In respect to real estate act & regulation, the hon.PM & govt. have made good effort to regularised and control over the manipulation in estate business, I want to suggest that,real estate sector is very important for the govt. scheme "Home to all" to the poor and needy people, therefore, it require some relaxation to encourage the scheme and persons who are connected with business of real estate,e.i. taxation,stamp duty,financial sources etc. relief can be given,GST will also give benefit

FOR GREEN FEILD PROJECTS - Uniform Development Control Rules including set back for all greenfeild project needs to comply with National Building Code / SP7. The team of personnel and competency requirements of professionals mentioned in SP7 needs to be complied with. Professional guilds like CoA / ITPI/ Inst of Engineers needs to be strict in implementing code of practice and ethics. All project investors / bankers should be made responsible for project complying SP7.

sir,average life of building as per government is 50 to 60 yrs,but present quality is dangerous,real estate developer,in responsible cases engineer,architect,good mason surrender under working labour,after huge wage rise output quality interest lost,ALL NEW DEVELOPMENT NEED TO SHIFT TOWARD READY SOLUTION FACTORY MADE IN HOUSING LIKE PRECAST SLAB/WALL/TOILET/WHICH WILL BE MORE CONVENIENT FOR OUR GOOD,COST/QUALITY/WARRANTY/NO SKILL IS REQUIRED IN ADMIXTURE,EASY TO INSPECT.

रियल एस्‍टेट अधिनियम के अंतर्गत शहरी गरीबो को आवास उपलब्‍ध कराने के लिये भू खंड देने का प्रावधान है इसमें सबके लिये आवास योजना के अंतर्गत निर्धारित राशि का भुगतान कर शासन द्वाराा नगर निगम/नगरीय निकाय के माध्‍यम से आवास बनाकर देने का प्रावधान किया जावे आवास आबंटन का कार्य नगरीय निकाय के माध्‍यम से किया जावे नियमो में शर्ते निर्धारित करने का अधिकार नगरीय निकाय को हो रियल एस्‍टेट में पर्यावरण संरक्षण का प्रावधान कडाई से लागू किया जावे

regulation & law in real estate will improve functioning in new genuine development,major damage already done,issue illegal construction with help of local body/poor quality/non possession/cheating/failure of court justice, on top demand is fake,real estate mega project mint for investment,for corrupt politician & black marketers same as investment for profit,with destruction of ecology,if we regularize undue purchase rate will be in control

dear sir, all are aware that population is growing rapidly in india by onother decade our country may add many million of peoples,then there is scarcity all things so,govt must see that the cost of the land will be fixed by the cenral govt to see that poorest of the poor must be in position to acuirqe land have his/her house.as the modijis govt is for the poor they may do right things

There is a need for compulsory warranty / guarantee for buildings built by real estate developers. Many of the constructions are often sub standard and problems start cropping up few years down the lane. As a minimum constructions must have a 10 year warranty. Also it is not uncommon for real estate developers to deviate from the planning permission and cheat the buyers. This kind of cheating and misleading of customers must be declared a criminal offence.

#RealEstate GOI must rationalise amount of household land owning for a family 1 land or flat at max 2 this will stabilise prices black money dumping will decrease in this sector, similarly with commercial land. since money which was earlier invested in buying new land will be used for earthquake resistant construction less destruction at time of disaster, money could be routed to share market and other areas...
