The Ministry of MSME is in the process of amending the MSMED Act, 2006. In this regard, this Ministry had consulted various central Ministries/Department/State Govt./Industry Associations/other stakeholders & general public.

Based on the consultations and written inputs received from various stakeholders, the amendments proposed in the MSMED Act, 2006 are based on the following four key pillars:

A) Enhancing inclusivity and broad-basing the scope of the Act;
B) Future-proofing the Act;
C) Improving co-ordination under the Act;
D) Enhancing the ease of business in the ecosystem;

A) Enhancing Inclusivity and Broad-basing the scope of the Act
• Accord statutory status to Udyam registration for availing benefits under the Act.
• Provision for credit guarantee coverage to Micro and Small Enterprises by Government.
• Enabling provisions to address issues of credit gap; shortage of working capital; ensure adequate, affordable, and timely finance to enterprises; minimize the incidence of financial stress among enterprises; and leverage new and emerging platforms and technologies such as the Trade Receivables Discounting System, Account Aggregator Framework, etc.
• Provision for targeted mechanisms for capacity building of women, members of SC and ST, and rural artisans and craftspeople and provisions for market access, financial and digital literacy.
• Inclusion of cottage, village, and coir industries as rural artisans and craftspeople in the MSME classification scheme, to promote rural industries and enterprises.
• Inclusion of Medium Enterprises in the dispute resolution framework

B) Future-proofing the Act
• Strengthen provisions for technological upgradation and green technology to enhance productivity, quality, and competitiveness.
• Enabling provisions for the adoption of energy-efficient, sustainable technologies by MSME.
• Designation of a Green Fund to support the energy transition of MSME and integration in the global value chain.
• Addressing industrial obsolescence among enterprises.
• Promoting technological upgradation and research and development among enterprises.
• Encouraging the adoption of sustainable technology solutions by enterprises.

C) Improving coordination
• Streamline the structure, working, and functions of the National Board and the Advisory Committee to make them lean, efficient, and responsive to the requirements of MSME, and strengthen the monitoring and evaluation mechanism.
• Provision to set up an adequate number of Facilitation Councils in States for better access to MSMEs, along with an incentive structure to promote competition and good performance among them.
• The composition of the Facilitation Councils may be prescribed by the State Government.

D) Enhancing Ease of Business in the Ecosystem
• Provisions for the decriminalisation of offences by converting criminal fines into civil penalties.
• Simplification of regulatory clearance mechanism and procedure for establishment and management of MSME by making suitable provisions in the Rulemaking powers of the appropriate Government.
• Creating and encouraging the adoption of digital solutions to improve transparency and foster a culture of accountability
• Make the adjudication process simpler and speedier, aligning it with the alternative dispute resolution framework and online dispute redressal.

as every one is concerned about population growth why cant govt makes a law for this at least stop paying money for deliveries after 2 child birth why cant govt allows private nursing home hospital to give benefits which are provided after delivery in govt sector if this is done then govt hospital working will be good due substantial decreases work load

According to the act, "any buyer who fails to make payment to MSMEs, as per agreed terms or a maximum of 45 days, would be liable to pay monthly compounded interest at three times the bank rate notified by RBI".

MSMED act is a regulator of msme sector of our country.my view is to eco friendly Msme sector will be better of our country.second subsidy will be given for use green technology in msme sector.third a digital certificate has been issued for all traders .fourth rural msme and urban msme will be divided for make policy.

MSMED is a act to regulate and control msme sector in our country.some changes has been doing in this act.my view is to a region wise and sector wise policy has been framed .second legal tribunal has been established for resolve any query related to it.third policy specialist has been included from grass route level.

Government should focus on itself before preaching MSME , Business, Individual taxpayers: 1.Why provide subsidised house,subsidised electricity,rent to army people,Government employees ,PSu employees if you provide allowance so cancel the subsidy and increase rent for army ,PSu 2.Why waste money on buying acre level of lands for less efficient government offices when private do it more efficiently in square feet offices? 3.Why waste money on building township and providing accomodation to employees when there are millions of homes outside? 4.Why provide drivers,cars, on contract when a employee can drive his own car? 5.Why waste money 20rs. on water bottles for government employees,ministers,and meetings when a entire can be bought for 30 rs.? 6.Why organise meetings in 5 stars hotels and waste taxpayers money when you own and waste millions of acres and make PSu run in losses? 7.When you charge a hefty tax is there quality in government schools or colleges ?

Replacing the current system of penalizing buyers who fail to make payments to MSMEs could be approached in several alternative and feasible ways. (1) Early Payment Incentives: Instead of focusing solely on penalties for late payments, incentivize early payments by offering discounts for buyers who pay promptly or before the due date. (2) Flexible Payment Terms: Negotiate flexible payment terms that align with the cash flow cycles of both the buyers and MSMEs (3) Prompt Payment Codes: Implement industry-specific prompt payment codes or agreements that outline clear expectations and consequences for late payments (4) Dispute Resolution Mechanisms: Establish efficient and accessible dispute resolution mechanisms to address payment issues promptly. (5) Technology Solutions: Implement digital invoicing and payment systems that automate invoicing, reminders, and payment. A combination of these approaches may be most effective in replacing the current penalty-based system.

we must put in a condition that all MSMEs will use eco-friendly items and no one will use plastic or polyethylene. They will spend at least 10% of their profit in plantation and save water activities.

8. Our best part part in our country is most of the products are go green, sustainable , organic especially clothes, jute items , bags , organic food items etc all over India. "One district one product", "One station one product" can extended and we can promote in possible ways , exports etc

7. App based products are latest and easy for online purchase. It is quick as well. Probably we can encourage start-ups to have app based service also in possible conditions.
